sp3c messaged me earlier with a link for DA and the :S emoticon

as Josh pointed out he did mention in our original phoenix thread that he used someone else\'s image for reference...well, you be the judge as to how much reference and how much originality went into it.

From the staff room. Essentially, we have to decide very carefully whether there the line is being crossed between simularity and artistic rights, and the side of infringement on artwork. One side can be handled with a \"thanks\", the other could lead to legal problems, since the logo is now on thousands of merchandising things...

I think we need to have an emergency meeting. Like, tomorrow emergency. DSL is coming in a week and a half, and if a change needs to be made, it needs to be done yesterday fast.

Problem, I have a competition to attend to tomorrow night. I leave at 4:30pm.. I also have appointments and other stuff I need to attend tomorrow all day long. I\'m sure you guys (and tami) can have this meeting without me, just give me transcripts.

To me that looks like a blatant rip. The only diffrence is that Rob\'s is smoother and more refined.
I currently can\'t work one one coz i\'ve got a test in biology tomorrow and then a french and then exams... could you perhaps settle something with the owner of that image; say a year or two of free server hosting for exchange of the copyright for the image?

just ideas.

Guess we should\'ve asked what he used back then. The user hasn\'t been on DA in 86 weeks, so I don\'t think contacting will be easy.

There are differences in the two, not many but they do exist. I would leave it as is for now until after DSL, then we can worry about changing it. We\'ve been using it for about a year and a half without any problems, I don\'t see what another few weeks will bring. This is unless we\'ve received any complaints about it, which I haven\'t seen.

Yes but DSL will be on video, and sponsor will be looking at the logo, so thats a worry.

I think the changes arn\'t enough, sure they\'re small but overall, its exactly the same design.

seeeeeeeeeeeeeeeeeeee we\'re not the only ones with a ...similar.... design; but I still feel this is something we should address as soon as possible once digital storm is over.

there is a big diffrence from the logo killanet used that from the original for one it looks hella better than the original and its has more design to it. its thicker has more detail to it so there shouldnt be any problems well thats just my toughts if you keep looking at the animated one you see the big diffrences from the orginal

Isn\'t a trademark or something only for an exact copy? Like you can use a logeo if you just chance some details from it, this is how the but clothing companies can\'t seu most fake clothing. It\'s because they aren\'t 100% exact to the original product.

Anyway that\'s what I think, I\'m not sure if it\'s true...

Yes you can make a minimum of 10% changes from the original; however, ours is so very similar in design, it doesn\'t take any stretch of the imagination as to where it came from. I have been working on a new phoenix logo, I just haven\'t gotten it to a point where I am satisified with it yet.
