Hi everyone
as some of you know i am a dog breeder. As such i am more frequently accepting deposits on puppies through paypal....i even encourage it - there are no bounced cheque fees for me and the money gets here quicker - and that person can reserve X puppy almost immediately before someone else pulls up in the driveway.
i havent met a breeder yet that, should they take deposits on a puppy, do not firmly state and have you sign a form that your deposit is non-refundable. my deposit agreement is basically as so" deposit is only refundable should the puppy die whilst in my care. if puppy is not paid for in full by X date BUYER forefits any claim to this puppy and it may be sold to another." i do not refund the deposits...i'm not walmart....i held that puppy for you, fed it, cleaned it, gave it the shots, deworming...all of that. deposits are there to help weed out those who are not serious about buying that puppy. unfortunately certain circumstances to happen in our lives to where the buyer cannot take the dog....still, while i understand and sympathise, NO REFUNDS.
so with that in mind i have posted below a dispute arrising from this from a fellow breeder who has a very similar policy. i just wanted to intro it a little. sorry its in caps she was pretty mad when she posted - hence the little censor fella lol.
i'm just wanting to collect your thoughts on this....the buyer knew there was no refunds, she didnt like it and then got paypal involved.

I am attatching the response form pay pal...I am appealing it.... This is an outrage and I am SP PISSED OFF!!!!!!

personally i think paypal shouldnt have been involved...there was a prior agreement and unless they change their decision, they will no longer get my substantial business....and i'm sure this can apply to many others who have small at home businesses that use paypal for one reason or another.

what does everyone else think?

I think she needs to find herself a lawyer who is willing to take on PayPal and force a legal argument about the issue if PayPal doesn\'t come \'round to seeing how deposits work in regards to the animal breeding industry. However, this person also needs to conduct herself in a calm, businesslike manner because she won\'t get anywhere by yelling, etc. with PayPal. If she could win a legal precedence in regards to deposits on puppies, then PayPal would have no choice but to comply with the law. If there are already legal precedences available for use to support her argument, I suggest she present them to PayPal once again in a calm, rational manner.

i agree with her needing to calm down.
however, the deposit at most would have been between $100-$600....i'm not sure if it would be worth the aggravation and costs to hire a lawyer - even though it would be great if someone did...apparently it isnt the only time this has happened, but i know if i was in her position i wouldnt want any further hassle.
i'll just stick to cash only...its a shame, but unless they can register a buyers complaint with the us mint im thinking i should be fairly safe.

She could check with the local colleges/universities and see if their graduate students offer any type of legal service-most usually do. It\'s also possible that she could search the case law history herself, if she knows where to look for what she would need. Start with state laws, then move on to federal laws.

She'll get owned by the legal system. She should speak properly to a large business as speaking like that shows how immature and irrational a person is.

immature and rational? i think if you had $1000 taken out of your account you'd react - initally the same way. i totally agree she needed to calm down as yelling with a company like this more than likely wont get you what you want - some it does unfortunately.
i totally sympathise with the circles they led her around...and thankfully after much effort she got what she wanted. her update is included below....i believe the caps are because she's so happy....i would be, i'd be yelling it all over !
